Welcome to Her Own Sky

These Terms of Service ("Terms") govern your use of HerOS, the mobile and web application provided by Her Own Sky LLC ("we," "us," or "Her Own Sky").

By creating an account or using HerOS, you agree to these Terms. If you don't agree, please don't use HerOS.

1. Your Account

Eligibility: You must be at least 13 years old to use HerOS. If you're under 18, you need parental consent.

Account Security: You're responsible for:

• Keeping your password secure
• All activity that happens under your account
• Notifying us immediately if your account is compromised

One Account Per Person: You may only create one account. Multiple accounts may be suspended.

2. Acceptable Use

You agree to use HerOS responsibly. You may NOT:

• Violate any laws or regulations
• Harass, abuse, or harm others
• Upload viruses, malware, or malicious code
• Scrape, crawl, or reverse-engineer HerOS
• Use HerOS for spam, fraud, or scams
• Impersonate someone else
• Access another user's account without permission
• Interfere with HerOS's functionality or security

3. Your Content

You Own Your Data: All tasks, notes, goals, and information you create in HerOS belong to you.

License to Us: By using HerOS, you grant us permission to:

• Store and display your content within the app
• Use your content to provide and improve HerOS (like analyzing usage patterns)
• Back up your content for security and recovery

We will NEVER:

• Sell your content
• Share your content publicly without your permission
• Use your content for advertising

You're Responsible for Your Content: Don't upload anything illegal, harmful, or that violates someone else's rights.

4. Subscriptions & Payments

Free Tier: HerOS offers a free version with limited features.

Premium Tier: Paid subscriptions unlock additional features. Pricing is displayed in the app.

Billing:

• Subscriptions renew automatically (monthly or annually, depending on your plan)
• You'll be charged at the start of each billing period
• We'll notify you before any price changes

Cancellation:

• You can cancel anytime from Settings → Subscription
• You'll retain access until the end of your billing period
• No refunds for partial months

Refunds: We don't offer refunds except where required by law. If you believe you were charged in error, contact us at support@herownsky.com

5. Intellectual Property

HerOS is Ours: All rights, title, and interest in HerOS (including design, code, features, branding, and content) belong to Her Own Sky LLC.

You May NOT:

• Copy, modify, or create derivative works of HerOS
• Sell, license, or distribute HerOS
• Remove or alter any copyright notices

Feedback: If you share ideas, suggestions, or feedback with us, we're free to use them without compensation to you.

6. Third-Party Services

HerOS integrates with third-party services (like Google Calendar, Apple Health, Stripe, etc.). Your use of those services is governed by their own terms and privacy policies. We're not responsible for third-party services.

7. Disclaimers

HerOS is Provided "As Is":

• We strive for excellence, but we don't guarantee HerOS will be error-free, uninterrupted, or perfectly secure
• You use HerOS at your own risk
• We're not liable for data loss, so please back up important information

8. Limitation of Liability

To the fullest extent permitted by law:

• Her Own Sky is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of HerOS
• Our total liability is limited to the amount you paid us in the past 12 months (or $100 if you're on the free tier)

Some jurisdictions don't allow these limitations, so they may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless Her Own Sky from any claims, damages, or expenses (including legal fees) arising from:

• Your use of HerOS
• Your violation of these Terms
• Your violation of someone else's rights

10. Termination

You Can Leave Anytime: Delete your account from Settings → Account → Delete Account.

We Can Terminate Your Account If:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We're required to do so by law
• We discontinue HerOS (we'll give you reasonable notice)

After Termination: You lose access to HerOS, and we'll delete your data per our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we'll notify you via email or in-app. Your continued use of HerOS after changes means you accept the updated Terms.

12. Dispute Resolution

Governing Law: These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles.

Arbitration: Any disputes will be resolved through binding arbitration in Minneapolis, Minnesota, not in court. You can opt out of arbitration by emailing us at legal@herownsky.com within 30 days of account creation.

Class Action Waiver: You agree to resolve disputes individually, not as part of a class action.

13. General

• Entire Agreement: These Terms (plus our Privacy Policy) are the complete agreement between you and Her Own Sky.
• Severability: If any part of these Terms is unenforceable, the rest still applies.
• No Waiver: If we don't enforce a provision, it doesn't mean we waive the right to enforce it later.
• Assignment: You can't transfer your rights under these Terms. We can assign our rights to a successor or affiliate.
